- Acceptance of Conditions
These conditions applicable to online purchases (the “ Conditions ”) constitute an agreement between you (“ you ” or the “ Customer ”) and Thérapie CPAP Outaouais., located at 201-28 boul. du Mont-Bleu, Gatineau (Québec) Canada J8Z 1J1 (“ we ” or “ Thérapie CPAP Outaouais ”), which is the owner and operator of the website whose URL address is https://www.boutiquetco.com (the “ Site ”). The Site is intended for users who have reached the age of majority in their territory of residence and who have the capacity to contract.
These Conditions govern the purchase of Products on this Site. “ Product(s) ” means any item for sale on the Site, including the services offered.
Thérapie CPAP Outaouais provides you with access to the Site and allows you to use it on the condition that you comply with and respect the Website Terms of Use and the Privacy Policy , which are incorporated by reference herein. By submitting your order on this Site, you accept these Terms, including the Website Terms of Use and the Privacy Policy, and you agree to comply with all applicable laws and regulations .
2. Guarantees
Unless specifically indicated for a given model or manufacturer, the warranties listed below apply to all products of the same category. To consult the terms of the guarantees applicable to the Products, we invite you to consult the following table:

Subject to the terms and conditions contained in the manufacturer's warranty contract that you find in the user manual, Thérapie CPAP Outaouais undertakes to exchange or have repaired any defective item, acquired from one of its authorized representatives, during the entire warranty period indicated in the table below. In the event of an exchange, Thérapie CPAP Outaouais will attempt to replace the item either with a new item or a refurbished item of equivalent quality and value, subject to the availability of devices and parts from the manufacturer. This commitment applies to the extent that:
- The item is maintained and used in accordance with the specifications in the user manual and/or accessory replacement guides;
- The part of the item to be repaired or replaced is an original part or an original spare part, the repairs and/or replacements being carried out by Thérapie CPAP Outaouais, the manufacturer and/or an authorized person;
- Normal precautions have been taken to keep the item in good condition;
- The item has not been subject to unauthorized modifications, misuse, neglect or accidents caused by water or animals;
- The item has not been used for purposes other than those for which it is designed or has not been used with accessories other than those recommended;
- The item bears the original manufacturer's identification marks (serial #);
In the event of non-compliance with points 1 to 6, Thérapie CPAP Outaouais and/or the manufacturer reserves the right to cancel the warranty. In such a case, any repair and/or exchange, as well as the related transport costs, will be at your expense.
A repair or exchange does not extend the duration of the manufacturer's warranty.
- Product Description
Thérapie CPAP Outaouais attempts to be as accurate as possible on the Site. However, Thérapie CPAP Outaouais does not guarantee that Product descriptions or any other content on the Site are accurate, complete, reliable, up-to-date and/or error-free. If the Product you received does not correspond to the description of the Product you ordered on the Site, Thérapie CPAP Outaouais ' liability is limited to refunding you the value of the Product if it is returned to Thérapie CPAP Outaouais in its original condition (unpacked), and within ten (10) days following the date of invoice for the Product. For more information regarding the steps for returning a Product, please consult our Product Return Policy set forth in Section 14 hereof.
- Errors on the Site
Thérapie CPAP Outaouais reserves the right to revoke any offer displayed on the Site, to refuse or cancel any order and to correct errors, inaccuracies or omissions on the Site, at any time and without notice, even after submission of an order and even if the order has been confirmed and/or if your credit card has been charged. In the event that your credit card has already been charged and your order is canceled, Thérapie CPAP Outaouais will reimburse you for the full amount charged, using the original payment method.
- Price policy
Product prices are subject to change without notice. The prices displayed on the Site are in Canadian dollars.
- Sales Tax Policy
Thérapie CPAP Outaouais collects and remits sales tax as required by law.
- Sale for personal use
The Products offered on the Site are offered to end users only, for personal use and not for resale.
- Conditions for purchasing a sleep apnea treatment device.
CPAP machine
Purchasing a CPAP device requires a valid doctor's prescription. The order must include:
- your name and date of birth;
- the type of device prescribed (fixed or variable);
- the setting pressure of the device; And
- the doctor's signature.
If the respiratory therapist does not find a valid prescription in your customer file, you will be contacted before your order is shipped. Once the prescription is received and the order validated, the device will be shipped by Canada Post.
When you receive your CPAP device at the shipping address you provide to us, it will have been calibrated by a respiratory therapist according to the prescription in your client file and ready for use.
- Payment for your order
You can pay for your orders on the Site with a major credit card issued in Canada, with a billing address in Canada.
Credit cards are billed upon confirmation of the online order on the Site, including any applicable taxes and/or shipping/handling charges.
- Validation of your order
After you have placed an order on the Site, Thérapie CPAP Outaouais will verify the validity of the information you have provided by verifying your payment method, your billing address and your shipping address in Quebec. Thérapie CPAP Outaouais will also check the quantity and current inventory status of the requested Product. When required by current laws, Thérapie CPAP Outaouais will verify that the medical prescription necessary for the purchase of a particular Product is present in your customer file.
Thérapie CPAP Outaouais reserves the right to limit the quantities of Product that you can purchase, particularly during a promotion, discount offer or bonus.
- Acceptance/confirmation of order
You will receive by email a confirmation of the order placed on the Site.
Your receipt of an order confirmation electronically or in any other form does not constitute acceptance of your order by Thérapie CPAP Outaouais. At any time after placing your order, Thérapie CPAP Outaouais reserves the right to accept or refuse your order for any reason. In the event that Thérapie CPAP Outaouais refuses your order, Thérapie CPAP Outaouais will reimburse you the amount debited by the original payment method.
- Out of stock
Thérapie CPAP Outaouais cannot under any circumstances guarantee the availability of the Products offered on the Site. Thus, all orders placed on the Site are subject to Product availability and will be shipped under the Shipping Policy stipulated in section 13 below.
In the event that a Product is out of stock, Thérapie CPAP Outaouais will contact you and inform you of the out of stock. At your option, Thérapie CPAP Outaouais may send you the Product as soon as it becomes available again or Thérapie CPAP Outaouais will cancel the order and refund you the amount debited by the original payment method.
- Shipping Policy
Please note that no order will be shipped until all Products contained in the order are ready and available for shipment. In addition, no orders will be shipped outside of Quebec, except at the discretion of Thérapie CPAP Outaouais .
Shipping charges are added to all orders with a total value of less than $75 before applicable sales taxes. There will be no shipping charges for any order valued at $75 or more before applicable sales taxes. The charges applicable to your order will be clearly indicated where applicable before you finalize your purchase of Products on the Site.
Additional shipping charges may apply for any order shipped to remote areas, either outside major urban centers or areas not served by Canada Post (XpressPost). Before making any such shipment, we will contact you to obtain your consent to these additional shipping charges. If you refuse, Thérapie CPAP Outaouais will cancel the order and refund you the amount debited by the original payment method.

- Product Return Policy
All sales made via the Site are subject to this Product Return Policy. Thérapie CPAP Outaouais undertakes to reimburse you, in whole or in part, for the Products that you return to us, according to the conditions and within the time limits specified in this article 14, with the exception of a Product marked “NO- REFUNDABLE” for which no refund is offered.
Return of any other product purchased on the Site
Thérapie CPAP Outaouais grants you the privilege of returning, for reimbursement purposes, any Product that you have acquired on this Site (other than a CPAP device), during a period of ten (10) days following the date of the invoicing of the Product, provided that the Product has not been unpacked and is returned within said period, in its original condition (unpacked). When returning the Product, Thérapie CPAP Outaouais reserves the right to refuse, at its sole discretion, a refund request when all conditions for reimbursement have not been respected. If all conditions for reimbursement have been met, Thérapie CPAP Outaouais undertakes to reimburse you for the amounts received to date for the acquisition of said Product. A $15 return processing fee will be subtracted from the original cost and a credit for the difference will be issued. Delivery charges are not refundable. If you need professional advice following the purchase of a mask made on our site, we can offer you a consultation with a fee of $50. No possibility of exchange for any Product purchased on the Site (other than a CPAP device)
Steps for returning a Product
In order to return a Product, you can contact customer service by email at info@boutiquetco.com . Our agents will work with you to establish the most appropriate return method depending on your situation, either a postal return or a return directly to a service point.
If the postal return method is chosen, a Canada Post postal return slip will be sent to you by email.
Please follow the following steps:
- Before closing the package, make sure you have included all the items you wish to return.
- Print the postal return slip and affix it to the package containing the items you wish to return.
- A refund will be automatically issued to your original payment method within three (3) to five (5) business days following receipt of your package at our warehouse.
- Campaigns/promotions/competitions
Thérapie CPAP Outaouais reserves the right to cancel, modify or restructure, at any time, without notice and for any reason, any promotion, sale, contest, survey or other offer communicated by Thérapie CPAP Outaouais . The promotional codes offered by Thérapie CPAP Outaouais are valid until the date displayed or communicated or until stocks last, depending on the applicable terms and conditions. Any unused portion will be forfeited. Each promotional code is limited to one use per customer and one code per order. No promotional code can be combined with any other offer. No promotional code will have any cash value.
Any offer is void where prohibited, taxed or restricted by law. No offer is transferable. No offer will be applied retroactively to Products already purchased. No offers are valid on any resale activity. The Products and support acquired under these Terms are intended for your personal use and not for resale. Distributors and other resellers are not eligible for these offers.
- Terms of Use - Limited Warranties
Thérapie CPAP Outaouais does not offer any contractual guarantee to the user of the Products offered on this Site, other than those provided by law or by the standard guarantees linked to a particular Product. Thérapie CPAP Outaouais makes no express or implicit representation as to the expected results that may result from the use of any of the Products offered on this Site. You acknowledge that medical results may vary depending on circumstances or may not be achieved.
Before using a Product purchased on this Site, you should consult the user manuals provided with that Product. User manuals contain important information about the Product as well as instructions for the handling, use and maintenance of the Product. You are, at all times, responsible for ensuring that the handling, use and maintenance of the Product are carried out adequately, in accordance with the instructions contained in the User Manuals.
Ask your doctor about the risks inherent in the use of the Products offered on this Site.
- Representations
In the absence of express stipulation and except as to its own products and services, Thérapie CPAP Outaouais does not make any promotion or recommendation of a specific brand of Products. In addition, Thérapie CPAP Outaouais makes no representation regarding the Products, regardless of whether their use has been recommended to you by a third party or not. The Products, including CPAP devices, which have been prescribed by your doctor are used by you without any representation on the part of Thérapie CPAP Outaouais that they will extend your life expectancy or provide you with better health. Only your doctor can inform you about the possible results resulting from the use of these products and devices.
You acknowledge that Thérapie CPAP Outaouais , the members of its management and its directors, officers, employees, agents, as well as their respective successors and assigns will in no case be liable for damages, of any nature whatsoever, arising from the fact that a Product may be inappropriate for you, or that this Product may not have produced or resulted in the expected results, even if Thérapie CPAP Outaouais knew or should have foreseen the possibility of such damage.
- Convention on Applicable Laws and Jurisdiction
These Terms are governed and construed in accordance with the laws in force in the province of Quebec, without regard to conflict of laws rules. You agree to submit to the exclusive jurisdiction of the competent courts in Quebec, in the judicial district of Montreal, with regard to all questions relating to the Conditions, as well as in the context of any dispute that may arise with respect to of these questions. You also agree that the applicable laws are those of Quebec as well as the Canadian federal laws applicable in Quebec.
- Waiver
Any consent or waiver on the part of Thérapie CPAP Outaouais , whether express or tacit, concerning a failure on your part to comply with the provisions hereof, does not constitute consent or waiver of any other subsequent default or different nature.
- Divisibility
In the event that any provision of these Terms is found to be unlawful, void or unenforceable by a court of competent jurisdiction, such provision shall be deemed not to be part of the Terms and the remaining provisions shall remain in full force and effect.
- Updated Terms
Thérapie CPAP Outaouais may, at any time and without notice, modify these Conditions by updating this page of the Site. Please visit this page periodically to review the current Terms, which constitute the terms and conditions of purchase of Products on this Site. It is understood that the Conditions in force at the time you placed an order on the Site are the Conditions which apply to this order and those which bind you.
- Subcontracting
We may appoint a subcontractor or transfer the service of our obligations to third parties.
- Notice
You expressly agree that Thérapie CPAP Outaouais communicates with you, for any reason, at any telephone number, physical address or email address you have provided to us. Any notice will be in writing and may be sent by any reasonable means, including by mail, email, text message or recognized commercial courier.
- Applicable law
The interpretation of these conditions of sale must be done in conjunction with the legislation of Quebec.
